1 - General

The following terms and conditions apply to all orders placed by the customer (hereinafter "You") with MYO INGATLAN Ltd., (hereinafter "MYO INGATLAN Ltd.", "we" or "us" etc.), received via the MYO INGATLAN Ltd. website, mobile website, mobile app or telephone (all of which are referred to as "myohome.hu").

By placing an order on myohome.hu - by placing an "x" in the checkbox during the ordering process - you agree to the terms of use ("Terms") set out here. Please read the Terms before placing an order.

Orders may only be placed by a natural person over the age of 18, not under guardianship, not operating as a company, with a delivery address in Hungary (except for postal handling/transfer companies).

The availability of any product or service on myohome.hu at any time does not imply or warrant that such products or services will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to change these Terms from time to time without notice. Your order will be subject to the Terms and Conditions that were posted on myohome.com at the time you placed your order.

MYO INGATLAN KFT. wants to provide you with the best possible online experience. To do this, we need to make sure that our services work perfectly. You understand and agree that (i) you may not post, transmit, distribute, upload or promote any communication or content that could have a harmful or negative impact on our business, products or services; (ii) you may not engage in any conduct or use any means to restrict, inhibit, discourage or adversely affect other users of myohome.hu site or that affects the security of the site; or (iii) use or attempt to use any engine, software, device, agent, script or other device or mechanism (not including, without limitation, spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site or to copy content from the site. We reserve the right to terminate access to the Site immediately and to terminate the account of any user who violates this provision or any other provision of these Terms.

2 -Prices and delivery costs

The prices displayed on myohome.hu include VAT as required by law, but do not include delivery charges.

The delivery cost for all orders is the same, regardless of the size or weight of the order. The cost of each delivery method will be clearly indicated during the checkout process. Our standard delivery charge is 1500 Ft. If we are unable to dispatch your order in its entirety, we will not add any additional charges for additional deliveries. Prices may vary between shops and online.

3 - Order/contract performance

You can either order via myohome.hu or by e-mail or phone. Please visit our Customer Service page for more information.

Once you have placed your order, we will send you a confirmation email if you have provided us with your email address. If for any reason we cannot fulfil your order, we will let you know as soon as possible. If we have received payment for such an order, we will attempt to refund the relevant amount using the same payment method by which payment was received. If for any reason another solution is required, we will notify you and ask you to contact MYO INGATLAN LTD.

MYO HOME LTD undertakes to produce the goods ordered within 7 working days after receipt of the raw material. In case of delayed delivery due to reasons beyond our control, the buyer will be informed. Our company will only be responsible for the size of the home textile if a survey has been carried out on site by our colleague. We cannot be held responsible for any errors in the dimensions entered or taken over the telephone.

4 - Hand delivery

MYO INGATLAN KFT. will receive and process orders as quickly as possible and will make every effort to deliver the order to your residence address or other address in Hungary with the selected delivery terms.

MYO INGATLAN KFT. tries to send the parcels as soon as possible and in the order of receipt of the orders. We will endeavour to deliver within 2-4 weeks of order confirmation. While we do our best to fit within this timeframe, there may still be unexpected reasons why delivery may take longer. In the unlikely event that delivery is not made within 8 weeks, you may cancel your order.

Once you place your order, you will be informed of the expected delivery dates. Once your order has been submitted, we will confirm the expected delivery details by e-mail if you have provided us with your e-mail address.

If your order does not arrive on the scheduled date, please contact our Customer Service.

5 - Withdrawal from the order

We will start processing your order quickly, so we will not be able to modify it once it has been confirmed. This also applies to changes to the delivery address or delivery method. 

Contact us immediately using the contact details provided in the Customer Service. Once your order has started processing it is too late to cancel.  

CONSUMER INFORMATION ACCORDING TO THE GOVERNMENT DECREE 45/2014 (26.II.)

7.1. Information on the consumer's right of withdrawal

As a consumer, the Civil Code. According to Article 8:1, paragraph 1, point 3, only natural persons acting outside the scope of their profession, self-employment or business activity are considered consumers, so legal persons may not exercise the right of withdrawal without giving reasons!

The consumer has the right to withdraw from the contract without giving any reason according to Article 20 of Government Decree 45/2014 (26.II.). The consumer may exercise his right of withdrawal

  1. for a contract for the sale of goods
  2. the product,
  3. in the case of the sale of more than one product, if each product is supplied at a different time, the last product supplied,

by the consumer or by a third party other than the carrier and indicated by the consumer, within a time limit of 14 days from the date of receipt of the goods by the consumer.

Nothing in this point shall affect the consumer's right to exercise his right of withdrawal as set out in this point during the period between the date of conclusion of the contract and the date of receipt of the goods.

If the consumer has made an offer to conclude the contract, the consumer has the right to withdraw the offer before the conclusion of the contract, which removes the obligation to make an offer to conclude the contract.

7.2 The right of withdrawal may not be exercised in the following cases

The Service Provider expressly draws your attention to the fact that you may not exercise your right of withdrawal under Article 29 (1) of Government Decree 45/2014 (II.26.) include the following:

  1. in the case of a product which is not a prefabricated product, which has been manufactured on the instructions or at the express request of the consumer, or a product which is clearly personalised for the consumer;
  2. for sealed products that cannot be returned after opening after delivery for health or hygiene reasons;
  3. in respect of a product which, by its nature, is inseparably mixed with other products after the transfer.

7.3 The Service Provider also draws your attention to the fact that, under consumer protection legislation, you may use the product during the 14-day period for exercising the right of withdrawal only to the extent necessary to determine the nature and characteristics of the product (hereinafter referred to as "trying out").

If you return the product in a used condition, damaged or incomplete beyond the extent of the trial run, you are responsible for the depreciation and the Service Provider is not obliged to reimburse the full price of the product and the costs.

If the delivered item is faulty, please notify MYO INGATLAN LTD immediately and return the item in accordance with section 6 below (Returns). MYO INGATLAN LTD will refund the full price of any product found to be faulty. The terms and conditions set forth herein are without limitation of any rights provided by law.

Read the instructions carefully when you receive the wallpaper. By signing this contract, you certify that you have carefully read and accept our paragraph "Wallpaper Installation Instructions and Complaints Procedure".

6 - Return

MYO INGATLAN LTD guarantees a full refund in accordance with Section 5 (Cancellation of Order), provided that all items are returned in the condition in which they were received. This means that the items have not been damaged, soiled, washed or worn (except for trying on) and all labels and tags are intact.

Refunds will be made using the standard MYO INGATLAN KFT. refund process, via home delivery. For more details, please visit the myohome.hu Customer Service page.

7 - Payment methods

Credit card or debit card
You can enter your payment details using a credit card or debit card (VISA, Maestro or Mastercard) valid at the time of placing your order. The valid amount will then be debited from your card immediately. MYO INGATLAN LTD. reserves the right to verify the validity of the credit card or debit card, its creditworthiness in relation to the value of the order and the correctness of the address provided by the customer. Based on the results of these checks, we may refuse to fulfil orders.

Payment in cash on receipt
You can also choose to pay cash on delivery, free of charge, or pay a 50% deposit or cost of entry when you place your order. You can do this in person at our shop. You can find the exact address and contact details of our shop in the Contact Us section or contact our Customer Service.

MYO INGATLAN KFT. gift cards
You can also pay for part or all of your order placed on our website with a MYO INGATLAN KFT. gift card or MYO INGATLAN KFT. merchandise card. You can read more about the MYO INGATLAN KFT. gift card and how to combine it with other payment methods in the Gift Card menu.

We will send you the invoice document required by law in the e-mail confirming your purchase.

8 - Our responsibility

Nothing in these Terms and Conditions shall exclude or limit the liability of MYO INGATLAN LTD in any case where the exclusion or limitation of our liability would be contrary to law.

MYO INGATLAN LTD. assumes no liability for death or personal injury caused by us or by the negligence of our employees or agents. We will not avoid liability in the event of fraudulent or deceptive conduct by ourselves, our employees or agents. If we breach these Terms and Conditions, we will only be liable for such losses as may reasonably result from such breach.

MYO INGATLAN LTD. shall not be liable for indirect losses that are a side effect of the principal loss or damage, such as loss of profit or opportunity; or failure to deliver the Products or to perform any of our other obligations under these Terms, if the failure is the result of an event beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil commotion, war, nuclear accident and act of terrorism.

If you have a problem with a product that you have purchased online from MYO INGATLAN KFT. and your complaint has not been validated by MYO INGATLAN KFT., you can submit your complaint to the EU online dispute resolution platform ("ODR platform").

The ODR platform allows consumers and traders in the EU to try to settle complaints about online shopping out of court. This user-friendly and interactive website is available in all official EU languages and is free to use. Using the ODR platform, the consumer and trader can agree on a dispute resolution body and then go through a process to find a solution to the consumer's complaint. The ODR platform is available here: http://ec.europa.eu/odr.

9 - Colours and sizes
We make every reasonable effort to accurately display the characteristics of our products, including material composition and colours. However, the colours you see are determined by your computer system and we cannot guarantee that the computer will display the colours accurately.

The product sizes shown on myohome.hu are approximate values to give you a better idea of the cut or style of a particular product, but may not be an exact representation of the dimensions of the product. The actual dimensions of a product may vary depending on the material used in its production.

10 - Warranty, guarantee

If the purchased product is defective, MYO INGATLAN LTD will act in compliance with all applicable legal obligations. If you have a complaint about a product with a clear material or manufacturing defect, including a product damaged in transit, please let us know by returning the product without delay.

11 - Transfer

MYO INGATLAN LTD reserves the right to assign its claims arising from the delivery of the products to third parties or to charge them in favour of third parties.

12 - Partial invalidity

If any part of these Terms is found by any court or regulatory body to be invalid, the remaining Terms will continue to apply.

13 - Ownership

On myohome.hu, all intellectual property rights, such as trademarks or copyrights, remain the property of MYO INGATLAN KFT. or its licensors. The use of the myohome.hu site and its content, including the copying or storage of such content in whole or in part, except for your own personal, non-commercial use, is prohibited without the permission of MYO INGATLAN KFT.
